The Work permit is a condition that allows foreigners to work in Vietnam and is issued by a competent state agency of Vietnam, except for certain instances – as prescribed – in which a work permit is not required. A work permit may be revoked in the following cases:
1. Revocation of a work permit
Work permits may be revoked for any of the following reasons:
Expiration of the work permit
Termination or expiration of the Employment contract
The content of the employment contract is inconsistent with the content of the work permit
Inconformity of work performed
A written notice of termination of dispatch of the foreign employee to Vietnam
The foreigner’s employer – a Vietnamese party or foreign organization - has ceased operations
The employer or the foreign worker fails to comply with Decree 152/2020/ND-CP
The foreign worker, during his/her employment in Vietnam, neglects to abide by Vietnam’s law which compromises security and social order
2. Procedures for revocation
1. Items 1, 2, 3, 4, 5, 6, and 7 section I, within 15 days after the work permit ceases to be effective, the employer must revoke the work permit of the foreign worker and return it to the Ministry of Labor, War Invalids, and Social Affairs or the Department of Labor, War Invalids, and Social Affairs which issued that work permit and enclose a document specifying the reasons for revocation and work permits subject to revocation but cannot be revoked.
2. Items 8 and 9 section I, the Ministry of Labor, War Invalids, and Social Affairs or Department of Labor, War Invalids, and Social Affairs which issued the work permit must issue a decision on revocation of a work permit, using Form No. 13/PLI Appendix I – hereto appended – and request the employer to revoke the work permit of the foreign worker and then return it to the Ministry of Labor, War Invalids, and Social Affairs or Department of Labor, War Invalids, and Social Affairs.
3. Within 5-business days after receiving the said work permit, the Ministry of Labor, War Invalids, and Social Affairs or Department of Labor, War Invalids, and Social Affairs must send an acknowledgement of receipt of the revoked work permit to the employer.
